The vehicle is designated for transporting hazardous materials, as specified by the Secretary of Transportation, in quantities that necessitate placarding for both interstate and intrastate travel.

The Gross Vehicle Weight Rating (GVWR), Gross Combination Weight Rating (GCWR), Gross Vehicle Weight (GVW), or Gross Combination Weight (GCW) is at least 4,536 kg (10,001 lb) or higher, depending on the greater value.

The vehicle is intended or utilized to carry more than eight passengers, including the driver, for compensation.

The vehicle is built or operated to accommodate more than 15 passengers, including the driver, but is not intended for transportation services.
